The Scottish Ministers, in exercise of the powers conferred by section 22(1) and (2) of the Tobacco Advertising and Promotion Act 2002(1), hereby make the following Order:
1.—(1) This Order may be cited as the Tobacco Advertising and Promotion Act 2002 (Commencement No. 10) (Scotland) Order 2006.
(2) This Order extends to Scotland only.
2. 28th September 2006 is the appointed day for the coming into force of the Tobacco Advertising and Promotion Act 2002(2) in so far as that Act is not already in force.

This Order, which extends to Scotland only, brings into force on 28th September 2006 all the provisions of the Tobacco Advertising and Promotion Act 2002 (“the Act”) which are not already in force. Section 2 of the Act (the prohibition of tobacco advertising) was not previously in force in relation to website advertising. The Tobacco Advertising and Promotion Act 2002 etc. (Amendment) Regulations 2006 also inserts new provisions into the Act.

The provisions of the Act have been brought into force in England, Wales and Northern Ireland by S.I. 2002/2865 (as amended by S.I. 2003/258), 2003/396, 2004/3138 and 2006/2372.
2002 c. 36; “appropriate Minister” is defined in section 21.
The Tobacco Advertising and Promotion Act 2002 is amended by S.I. 2006/2369.
S.S.I. 2002/512 was amended by S.S.I. 2003/80.
