The Scottish Ministers, in exercise of the powers conferred by section 19(3) of the Farriers (Registration) Act 1975(1), hereby make the following Order:
1.—(1) This Order may be cited as the Farriers (Registration) Act 1975 (Commencement No. 4) (Scotland) Order 2006.
(2) This Order extends to Scotland only.
2. Section 16 of the Farriers (Registration) Act 1975(2) shall come into force on 30th March 2007 in those areas of Scotland excepted from the bringing into force of section 16 by the Farriers (Registration) Act 1975 (Commencement No. 3) Order 1981(3).

This Order brings section 16 of the Farriers (Registration) Act 1975 into force in a number of areas of Scotland with effect from 30th March 2007. Section 16 provides that it is an offence for any person who is not registered to carry out farriery.

The Farriers (Registration) Act 1975, with the exception of section 16, came into force throughout Great Britain on 1st January 1976 (S.I. 1975/2018). Section 16 was brought into force in Scotland on 8th May 1981 (S.I. 1981/767), except in Highland Region, Western Isles Islands Area, Orkney Islands Area, Shetland Islands Area and all other islands of Scotland. In England and Wales, section 16 was brought into force on lst June 1979 (S.I. 1978/1928).
1975 c. 35. The functions of the Secretary of State in so far as within devolved competence were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
Section 16 was amended by the Farriers (Registration) (Amendment) Act 1977 (c. 31), section 1(1) and (2) and paragraph 6 of the Schedule.
S.I. 1981/767. The Farriers (Registration) Act 1975 (Commencement No. 3) Order 1981 commenced section 16 of the Farriers (Registration) Act 1975 in Scotland with the exception of Highland Region, Western Isles Islands Area, Orkney Islands Area, Shetland Islands Area and all other islands, as those areas were constituted by section 1 of the Local Government (Scotland) Act 1973 (c. 65).
