PILOTAGE

The Argyll and Bute Council (Pilotage Powers) Order 2007

Whereas Argyll and Bute Council(1) is a harbour authority within the meaning of the Pilotage Act 1987(2) (“the 1987 Act”) for the harbour of Campbeltown but is not a competent harbour authority within the meaning of the 1987 Act;

And whereas Argyll and Bute Council wishes to be treated as a competent harbour authority for the purposes of the 1987 Act;

And whereas the Scottish Ministers have informed the persons they consider might be affected by this Order, in accordance with section 1(7) of the 1987 Act, and the making of the Order is not opposed;

Now therefore the Scottish Ministers, on the application of Argyll and Bute Council, in exercise of the powers conferred by section 1(4) of the 1987 Act(3) and of all other powers enabling them in that behalf, hereby make the following Order:

A council constituted under section 2 of the Local Government etc. (Scotland) Act 1994 (c. 39).

(3)

The functions conferred on the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
