The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and of all other powers enabling them to do so.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Zootechnical Standards Amendment (Scotland) Regulations 2007 and come into force on 14th December 2007.

(2) These Regulations extend to Scotland only.

Amendment to the Zootechnical Standards Regulations 1992

2.—(1) The Zootechnical Standards Regulations 1992(2) are amended in accordance with the paragraphs (2) to (4) of this regulation.

(2) In regulation 2(1) (interpretation), before the definition of “flock book” insert–

“Council Directive 87/328/EEC” means Council Directive 87/328/EEC(3) on the acceptance for breeding purposes of pure-bred breeding animals of the bovine species, as amended by Council Directive 2005/24/EC(4) with regard to the use of ova and embryos and storage centres for semen from pure-bred breeding animals of the bovine species;.

(3) After regulation 5 (acceptance for breeding purposes), insert–

Collection, processing and storage of semen

6.(1) A recognised organisation must ensure that semen referred to in Article 2 of Council Directive 87/328/EEC is, in respect of intra-Community trade–

(a)collected, processed and stored at an EC collection centre; or

(b)stored at an EC storage centre.

(2) A recognised organisation which fails to comply with paragraph (1) may have its recognition withdrawn by the Scottish Ministers by notice in writing at any time.

(3) In paragraph (1), “EC collection centre” and “EC storage centre” have the meanings given in the Bovine Semen (Scotland) Regulations 2007(5)..

(4) For Part V of Schedule 3 substitute–

PART VCRITERIA FOR ACCEPTANCE FOR BREEDING PURPOSES

Recognised organisations shall accept the use of–

(a)bovines for breeding purposes and for natural service; and

(b)ova and embryos,

which satisfy the criteria specified in Article 1 of Council Directive 87/328/EEC.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Zootechnical Standards Regulations 1992 (“the 1992 Regulations”).

The 1992 Regulations provide for the regulation of organisations that maintain stud books in relation to sheep, goats, pigs and bovine animals. They give effect to Council Directive 87/328/EEC on the acceptance for breeding purposes of pure-bred breeding animals of the bovine species.

These Regulations give effect to the amendments made to Council Directive 87/328/EEC by Council Directive 2005/24/EC with regard to the use of ova and embryos and storage centres for semen from pure-bred breeding animals of the bovine species.

A new regulation 6 is added to the 1992 Regulations (regulation 2(3)). This places obligations on recognised organisations in relation to the collection, processing and storage of semen from pure bred bulls.

Part V of Schedule 3 to the 1992 Regulations is substituted (regulation 2(4)). The new Part V requires that recognised organisations accept pure-bred bulls and cows for breeding purposes, and the use of ova and embryos from pure-bred cows for such purposes.

The functions conferred upon the Minister of the Crown under section 2(2) of the 1972 Act, insofar as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.
