The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 10(8) and (8A) of the Family Law (Scotland) Act 1985(1) and all other powers enabling them to do so.
1985 c. 37. Section 10(8) was inserted by the Pensions Act 1995 (c. 26), section 167(2)(b), and substituted by the Welfare Reform and Pensions Act 1999 (c. 30), Schedule 12 paragraph 8(3); Schedule 12 paragraph 8(4) inserted section 10(8A). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46) as read with section 91(4) of the 1999 Act which deemed paragraph 8(3) and (4) of Schedule 12 to the 1999 Act to be a pre-commencement enactment.
