The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 11(2), 17(2)(a) and 36(2)(b) of the Legal Aid (Scotland) Act 1986(1) and all other powers enabling them to do so.
In accordance with section 37(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1986 (c. 47); section 11(2) was amended, other than by a substitution of figures, by paragraph 61 of Schedule 10 to the Social Security Act 1986 (c. 50), paragraph 9 of Schedule 2 to the Jobseekers Act 1995 (c. 18), section 33 of the Access to Justice Act 1999 (c. 22), paragraph 12 of Schedule 3 to the Tax Credits Act 2002 (c. 21) and paragraph 4 of Schedule 3 to the Welfare Reform Act 2007 (c. 5). Section 36(2)(b) was amended by paragraph 6 of Schedule 4 to the Legal Aid Act 1988 (c. 34). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
