Port Babcock Rosyth Limited, incorporated under the Companies Act 1985(1) with Company number SC173116, has applied to the Scottish Ministers(2) for a harbour empowerment order under section 16 of the Harbours Act 1964(3);
No objections to the application have been made pursuant to paragraph 10(2)(f) of Schedule 3 to that Act(4);
The Scottish Ministers are satisfied as mentioned in section 16(5) of that Act;
The Scottish Ministers in exercise of the powers conferred by section 16 of that Act, hereby make the following Order–
The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
1964 c. 40; section 16 was amended by the Transport Act 1981 (c. 56), section 18 and Schedule 6, paragraphs 3, 4(1) and 14 and by the Transport and Works Act 1992 (c. 42), Schedule 3, paragraph 2.
Paragraph 10(2)(f) was substituted by S.I. 1999/3445 and is amended by the Transport and Works (Scotland) Act 2007 (asp 8, section 25(5)(e)).
