Scottish Statutory Instruments

2010 No. 98

Road Traffic

The Road Traffic (Parking Adjudicators) (Renfrewshire Council) Regulations 2010

Made

11th March 2010

Laid before the Scottish Parliament

12th March 2010

Coming into force

19th April 2010

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 73(11) and (12) of the Road Traffic Act 1991(1) and all other powers enabling them to do so.

In accordance with section 44 of, and paragraph 24 of Schedule 7 to, the Tribunals, Courts and Enforcement Act 2007(2), they have consulted with the Administrative Justice and Tribunals Council (3).

(1)

1991 c.40; section 82(1) contains a definition of “prescribed” relevant to the making of these Regulations. The functions of the Secretary of State so far as they exercisable within devolved competence were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).

(3)

Consultation was previously with the Council on Tribunals and its Scottish Committee under sections 8(1) and (3) of the Tribunals and Inquiries Act 1992 (c.53). Sections 8(1) and (3) of that Act are now repealed. Section 45(1) of the Tribunals, Courts and Enforcement Act 2007 abolishes the Council on Tribunals and its Scottish Committee, with section 44 of and Schedule 7 to that Act establishing the Administrative Justice and Tribunals Council in their place.
