The Scottish Ministers make the following Order in exercise of the powers conferred by section 149(2) of the Local Democracy, Economic Development and Construction Act 2009(1).
1. This Order may be cited as the Local Democracy, Economic Development and Construction Act 2009 (Commencement No. 1) (Scotland) Order 2011 and comes into force on 24th June 2011.
2. The day appointed for section 138 (application of construction contracts legislation) of the Local Democracy, Economic Development and Construction Act 2009 to come into force is 24th June 2011.

So far as extending to Scotland, this Order brings into force section 138 (application of construction contracts legislation) of the Local Democracy, Economic Development and Construction Act 2009 (“the Act”) on the 24th June 2011.
Section 138 inserts a new section 106A into the Housing Grants, Construction and Regeneration Act 1996 allowing the Scottish Ministers to disapply any or all of the provisions of Part 2 (construction contracts) of that Act as regards any description of construction contract.
Part 9 of the Act came into force on the date of Royal Assent on 12th November 2009.
