The Scottish Ministers make the following Order in exercise of the powers conferred by section 59(2) of the Planning etc. (Scotland) Act 2006(1).

Citation and commencement

1.  This Order may be cited as the Planning etc. (Scotland) Act 2006 (Commencement No. 12) Order 2011 and comes into force on 1st December 2011.

Commencement

2.—(1) Subject to paragraph (3), the provisions of the Planning etc. (Scotland) Act 2006 specified in paragraph (2), to the extent not already in force, come into force on 1st December 2011 for all purposes.

(2) The provisions are—

(a)section 20(3) (duration of listed building consent); and

(b)section 56 and the schedule (repeals).

(3) Section 56 and the schedule come into force on 1st December 2011 only for the purpose of the repeal of the provisions of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997(2) specified in the schedule.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings section 20(3) of the Planning etc. (Scotland) Act 2006 into force on 1st December 2011 and also commences the provisions of section 56 of and the schedule to the Act on that date to the extent that they repeal certain provisions of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 specified in the schedule.
