The Planning (Listed Buildings) (Amount of Fixed Penalty) (Scotland) Regulations 2011

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 39A(5) and (13) of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997(1) and all other powers enabling them to do so.

In accordance with section 82(3A)(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

1997 c.9; section 39A was inserted by section 24 of the Historic Environment (Amendment) (Scotland) Act 2011 (asp 3); “prescribed” is defined by section 81(1). The functions of the Secretary of State transferred to the Scottish Ministers under section 53 of the Scotland Act 1998 (c.46).

Section 82(3A) was inserted by section 30(4) of the Historic Environment (Amendment) (Scotland) Act 2011 and has been modified by paragraph 5 of schedule 3 to the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).
