The Scottish Ministers make the following Order in exercise of the powers conferred by section 21(5) of the Clean Air Act 1993(1) and all other powers enabling them to do so.
In accordance with that section, they are satisfied that the fireplaces exempted by this Order can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke.

1993 c.11. The functions of the Secretary of State under section 21 were transferred to the Scottish Ministers, so far as exercisable within devolved competence, by virtue of section 53 of the Scotland Act 1998 (c.46). Section 21 was amended by section 50(3) of the Regulatory Reform (Scotland) Act 2014 (asp 3).
