The Scottish Ministers make the following Order in exercise of the powers conferred by sections 1, 7(1), 8(1), 15(4), 25, 32(3), 34(7), 83(2), 83A(6) and 87(2) of the Animal Health Act 1981(1) and all other powers enabling them to do so.

1981 c.22. The functions of the Secretary of State in so far as within devolved competence were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). See section 86 of the Animal Health Act 1981 (“the Act”) for the exercise of functions in relation to tuberculosis. The requirement to obtain Treasury consent in section 32(3) of the Act was removed by section 55 of the Scotland Act 1998. The definition of “disease” in section 88(1) of the Act was extended to include tuberculosis and section 32 of the Act (power to slaughter animals) was applied to that disease by article 3 of S.S.I. 2007/147. The powers to make this Order are exercised together by virtue of section 33(2) of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10). The Order is subject to the negative procedure by virtue of section 33(4) of that Act.
