The Scottish Ministers make the following Order in exercise of the powers conferred by section 88(2) and (3) of the Air Weapons and Licensing (Scotland) Act 2015(1) and all other powers enabling them to do so.
1.—(1) This Order may be cited as the Air Weapons and Licensing (Scotland) Act 2015 (Commencement No. 4, Transitional and Saving Provisions) Order 2016 and comes into force on 30th September 2016.
(2) In this Order—
“the 2015 Act” means the Air Weapons and Licensing (Scotland) Act 2015;
“Licensing Board” means a Board continued in existence by or established under section 5 of the 2005 Act.
2. 30th September 2016 is the day appointed for the coming into force of the following provisions of the 2015 Act—
(a)section 42 (statements of licensing policy licensing policy periods);
(b)section 55 (overprovision).
3. Despite the commencement of section 42 of the 2015 Act—
(a)a licensing policy statement published under section 6(1) of the 2005 Act before 30th September 2016 continues to have effect on or after that date as it had before that date until a new licensing policy statement is published under section 6(1) of the 2005 Act; and
(b)a Licensing Board may continue to publish a supplementary licensing policy statement, within the meaning of section 6(2) of the 2005 Act, to any existing licensing policy statement mentioned in paragraph (a).
4. Where a decision of a Licensing Board under either section 23 or 30 of the 2005 Act is made prior to 30th September 2016, the amendments made by section 55 of the 2015 Act have no effect in relation to an appeal against that decision under section 131 of the 2005 Act.

This Order brings into force sections 42 and 55 of the Air Weapons and Licensing (Scotland) Act 2015 (“the 2015 Act”). The provisions are brought into force on 30th September 2016 (article 2).
Article 3 contains transitional provisions. Article 4 contains a saving provision.
Article 3 of the Order makes transitional provisions that have the effect that despite the commencement of section 42 of the 2015 Act, (a) any licensing policy statement already in existence prior to 30th September 2016 shall continue to have effect until a new licensing policy statement is published as per section 6(1) of the 2005 Act, and (b) a Licensing Board may continue to publish a supplementary licensing policy statement to their existing policy statement until a new licensing policy statement is published as aforementioned.
Article 4 of the Order makes a saving provision that has the effect that despite the commencement of section 55 of the 2015 Act the amendments therein shall not apply to the consideration of certain appeals of a determination of refusal of an application made under either sections 23 or 30, where the determination was made prior to 30th September 2016.
The Bill for the 2015 Act received Royal Assent on 4th August 2015. Sections 60(1) and (2), 84, 85, 86, 88 and 89 of the 2015 Act came into force on the following day.
