The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 17(2), (3) and (3ZA) of the Road Traffic Regulation Act 1984(1) and all other powers enabling them to do so.
In accordance with section 134(8)(2) of that Act they have consulted with such representative organisations as they think fit.
1.—(1) These Regulations may be cited as the M8 Motorway (Junction 29A Off Slip Road) (40mph Speed Limit) Regulations 2019 and come into force on 29 November 2019.
(2) In these Regulations “M8 Motorway” means the M8/A8 Edinburgh-Greenock Trunk Road.
2. A person must not drive any motor vehicle at a speed exceeding 40 miles per hour on the length of the M8 Motorway specified in the schedule.
3. The speed limit imposed by regulation 2 does not apply to any—
(a)vehicle falling within regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011(3) when used in accordance with regulation 3(5) of those Regulations,
(b)vehicle used for the purposes of Her Majesty’s Coastguard in an emergency.

Regulation 2
That length of the M8 Motorway being the Junction 29A off slip road from a point 476 metres or thereby south-east of the entry onto the A8 Greenock Road at Craigmuir Roundabout in a north-westerly direction for a distance of 470 metres or thereby.

These Regulations make provision for the regulation of the speed of traffic using the part of the special road section of the M8/A8 Edinburgh-Greenock Trunk Road known as Junction 29A.
Regulation 2 makes provision for a 40mph speed limit on the section of the off slip road at Junction 29A which is described in the schedule.
No business and regulatory impact assessment has been prepared for these Regulations as no impact upon business, charities or voluntary bodies is foreseen.

Section 17(2) was amended by the New Roads and Street Works Act 1991 (c.22), schedule 8, paragraph 28, by the Road Traffic Act 1991 (c.40), schedule 4, paragraph 25 and schedule 8, paragraph 1, by the National Parks (Scotland) Act 2000 (asp 10), schedule 5, paragraph 11 and by the Scotland Act 2012 (c.11), section 21(3). Section 17(3ZA) was inserted by the Scotland Act 2012, section 21(4).
Section 134(8) was inserted by the Scotland Act 2016 (c.11) schedule 2, Part 1, paragraph 12(5).
