The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 94(1)(b)(i) and 122(2)(b) of the Public Health etc. (Scotland) Act 2008(1), and all other powers enabling them to do so.
In accordance with section 122(6) of that Act, the Scottish Ministers consider that these Regulations need to be made urgently, without a draft having been laid before, and approved by resolution of, the Scottish Parliament.
1. These Regulations may be cited as the Health Protection (Coronavirus) (International Travel) (Scotland) Amendment (No. 10) Regulations 2020 and come into force at 4.00 a.m. on 22 August 2020.
2.—(1) The Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020(2) are amended as follows.
(2) In Part 1 of schedule A1 (countries and territories),
(a)omit—
(i)“Austria”,
(ii)“Croatia”,
(iii)“Switzerland”,
(iv)“Trinidad and Tobago”, and
(b)after “Poland” insert “Portugal”.
(3) In Part 1 of schedule 2 (persons not required to comply with regulations 3 or 6)—
(a)in paragraph 2, for “14 days of their arrival” and in paragraph 4, for “14 days of arrival” substitute “the period during which they would, but for this paragraph, have had to stay in specified premises in accordance with regulation 6”.
(4) In Part 2 of schedule 2 (persons not required to comply with regulation 6)—
(a)in paragraphs 14 and 25, for “14 days of their arrival” substitute “the period during which they would, but for this paragraph, have had to stay in specified premises in accordance with regulation 6”.
(5) In schedule 3 (specified competitions), after paragraph 28 insert—
“29. Dubai Duty Free Irish Open Golf Tournament (European Tour)
30. The Northern Ireland Golf Open Tournament (European Challenge Tour supported by the R&A)”.
3. The amendments made by these Regulations do not apply in relation to any person who arrived in Scotland during the period beginning at 12:01 am on 8 June 2020 and ending immediately prior to the coming into force of these Regulations, and the Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020 continue to apply to such persons as if the amendments made by these Regulations had not been made.

These Regulations amend the Health Protection (Coronavirus) (International Travel) (Scotland) Regulations 2020 (“the International Travel Regulations”).
They remove Austria, Croatia, Switzerland and Trinidad and Tobago from the list of exempt countries and territories in schedule A1 of the International Travel Regulations and add Portugal to that list. This means that persons arriving in Scotland on or after the time these Regulations come into force are no longer exempt from the movement restriction in regulation 6 of the International Travel Regulations if, during the 14 days preceding their arrival, they have departed from or transited through Austria, Croatia, Switzerland or Trinidad and Tobago.
Any person who arrives in Scotland on or after 4.00 a.m. on 22 August 2020 having departed from, or transited through, Portugal will be exempt from the movement restriction in regulation 6 of the International Travel Regulations.
They also make changes to the sectoral exemptions relevant to oil and gas workers and to crown servants or government contractors and foreign government officials. These changes are intended to specify the self-isolation period more clearly.
Finally, the Dubai Duty Free Irish Open Golf Tournament and the Northern Ireland Golf Open Tournament have been added to the list of specified competitions.
