The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 99(2) of the Social Security (Scotland) Act 2018(1).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Social Security (Scotland) Act 2018 (Commencement No. 6) Regulations 2020 and come into force on 27 March 2020.

(2) In these Regulations “the 2018 Act” means the Social Security (Scotland) Act 2018.

Days appointed

2.—(1) The day appointed for the coming into force of—

(a)section 10 of the 2018 Act (right to advocacy) is 30 June 2020, and

(b)section 11 of the 2018 Act (advocacy service standards) is 27 March 2020.

(2) For the purpose set out in paragraph (3) below, the day appointed for the coming into force of section 91 of the 2018 Act (guidance in relation to discretionary housing payments) is 1 April 2020.

(3) The purpose is to enable the Scottish Ministers to consult in accordance with section 91(4) of the 2018 Act.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations bring sections 10, 11 and, for limited purposes, 91 of the Social Security (Scotland) Act 2018 (“the 2018 Act”) into force on the days they appoint. Sections 10 and 11 relate to the provision of independent advocacy services in relation to the Scottish social security system. Section 91 relates to the power of the Scottish Ministers to publish guidance in relation to the exercise by local authorities of the power in section 88 of the 2018 Act to make discretionary housing payments. Section 91 is brought into force only for the purposes of allowing the Scottish Ministers to carry out the consultation required by section 91(4).
