The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 94(1)(b)(i) and 122(2)(b) of the Public Health etc. (Scotland) Act 2008(1), and all other powers enabling them to do so.

In accordance with section 122(6) of that Act, the Scottish Ministers consider that these Regulations need to be made urgently, without a draft having been laid before, and approved by resolution of, the Scottish Parliament.

Citation and commencement

1.  These Regulations may be cited as the Health Protection (Coronavirus) (International Travel and Operator Liability) (Scotland) Amendment Regulations 2021 and come into force at 4.00 a.m. on 22 September 2021.

Amendment of the Health Protection (Coronavirus) (International Travel and Operator Liability) (Scotland) Regulations 2021

2.  The Health Protection (Coronavirus) (International Travel and Operator Liability) (Scotland) Regulations 2021(2) are amended in accordance with regulation 3.

Amendments to schedule 1 (red list countries)

3.  In schedule 1 (red list countries), omit—

(a)“Bangladesh”,

(b)“Egypt”,

(c)“Kenya”,

(d)“Maldives”,

(e)“Oman”,

(f)“Pakistan”,

(g)“Sri Lanka”,

(h)“Turkey”.

Saving

4.  The amendments made by these Regulations do not apply in relation to a person who arrived in Scotland before 4.00 a.m. on 22 September 2021, and the Health Protection (Coronavirus) (International Travel and Operator Liability) (Scotland) Regulations 2021 continue to apply to such a person as if the amendments made by these Regulations had not been made.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus) (International Travel and Operator Liability) (Scotland) Regulations 2021 (“the International Travel Regulations”).

Regulation 3 amends the list of red list countries in schedule 1 of the International Travel Regulations. With effect from 4.00 a.m. on 22 September 2021, Bangladesh, Egypt, Kenya, the Maldives, Oman, Pakistan, Sri Lanka and Turkey are removed from that list. Persons arriving in Scotland at or after that time, having departed from or travelled through any of those countries or territories in the preceding 10 days will (unless they are eligible vaccinated arrivals within the meaning of regulation 3 of the International Travel Regulations or a person who is not required to comply with Part 4 or Part 6 of the International Travel Regulations), be required to self-isolate at specified premises in accordance with Part 6 (self-isolation) of the International Travel Regulations, and take a coronavirus test on day 2 and 8 following their arrival in Scotland in accordance with Part 4 (testing following arrival in Scotland) of the International Travel Regulations.

Regulation 4 makes saving provision to the effect that a person arriving in Scotland before these Regulations come into force must comply with the International Travel Regulations as they had effect at the time of the person’s arrival in Scotland. The amendments made by these Regulations apply only in relation to persons arriving in Scotland at or after 4.00 a.m. on 22 September 2021.

An impact assessment has not been produced for this instrument.
