The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 94(1)(b)(i) of the Public Health etc. (Scotland) Act 2008(1), and all other powers enabling them to do so.
In accordance with section 122(6) of that Act, the Scottish Ministers consider that these Regulations need to be made urgently, without a draft having been laid before, and approved by resolution of, the Scottish Parliament.
1. These Regulations may be cited as the Health Protection (Coronavirus) (International Travel and Operator Liability) (Scotland) Amendment (No. 2) Regulations 2021 and come into force on 30 September 2021.
2.—(1) The Health Protection (Coronavirus) (International Travel and Operator Liability) (Scotland) Regulations 2021(2) are amended in accordance with this regulation.
(2) In regulation 3(2)(d)(i) (interpretation: eligible vaccinated arrivals)—
(a)for “letter of certification” substitute “certification in paper or electronic form”,
(b)after “equivalent certification issued” omit “, in paper or electronic form,”.
(3) In paragraph 10(2) of schedule 4 (exemptions: transport)—
(a)in sub-head (ii) of head (a) for “any provision of EU-OPS” substitute “under Annex III or Annex VI of the Air Operations Regulation”,
(b)for head (c) substitute—
“(c)“Air Operations Regulation” has the meaning given in paragraph 1 of schedule 1 of the Air Navigation Order 2016(3).”.

These Regulations amend the Health Protection (Coronavirus) (International Travel and Operator Liability) (Scotland) Regulations 2021 (“the International Travel Regulations”).
Regulation 2(2) amends the International Travel Regulations to make electronic certification issued by NHS Scotland a form of proof of vaccination for the purposes of the definition of “eligible vaccinated arrival” in regulation 3 of the International Travel Regulations.
Regulation 2(3) corrects an error in paragraph 10(2) of schedule 4 of the International Travel Regulations by updating an exemption applicable to members of aircraft crew where they have travelled to the United Kingdom in the course of their work or are otherwise required to travel to the United Kingdom for work purposes.
An impact assessment has not been produced for this instrument.
