The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 88(1) of the Coronavirus Act 2020(1) and all other powers enabling them to do so.
The Scottish Ministers are satisfied that the conditions specified in section 88(11) of that Act are satisfied in relation to the provisions suspended by these Regulations.
1.—(1) These Regulations may be cited as the Coronavirus Act 2020 (Suspension: Disposal of Bodies) (Scotland) (No. 2) Regulations 2021 and come into force on 12 December 2021.
(2) In these Regulations, “the Act” means the Coronavirus Act 2020.
2. Parts 1, 4 and 5 of schedule 28 of the Act (and section 58 of the Act so far as it relates to those Parts) are suspended as they apply in Scotland(2).

These Regulations suspend the operation of Parts 1, 4 and 5 of schedule 28 (transportation, storage and disposal of dead bodies etc) and, so far as it applies to those Parts, section 58 (powers in relation to transportation, storage and disposal of dead bodies etc) of the Coronavirus Act 2020 (“the Act”) insofar as those provisions apply in Scotland. The suspension means that these provisions no longer have effect in Scotland but are capable of being revived by regulations made under section 88(3) of the Act. Parts 2 and 3 of schedule 28 of the Coronavirus Act 2020 were suspended by the Coronavirus Act 2020 (Suspension: Disposal of Bodies) (Scotland) Regulations 2021.
An impact assessment has not been produced for this instrument.
Parts 2 and 3 of schedule 28, and section 58 so far as it relates to those Parts, were suspended as they apply in Scotland by S.S.I. 2021/250.
