The Scottish Ministers make the following Order in exercise of the powers conferred on them by sections 3(5) and 60(3) of the Further and Higher Education (Scotland) Act 1992(1) and section 34(2) and paragraph 18(1) of schedule 2B of the Further and Higher Education (Scotland) Act 2005(2) and all other powers enabling them to do so.
In accordance with paragraph 18(2) of schedule 2B of the Further and Higher Education (Scotland) Act 2005, they have consulted with the regional board to which this Order relates, and other such persons as they considered appropriate.

2005 asp 6. Schedule 2B was inserted by section 11(2) of the Post-16 Education (Scotland) Act 2013 (asp 12) (“the 2013 Act”).

Section 60(2A) was inserted by paragraph 2(6)(b) of the schedule of the 2013 Act.

Section 34(4)(ca) was inserted by paragraph 8(22)(d) of the schedule of the 2013 Act.
