The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 23(1) and 24(2) of the Patient Safety Commissioner for Scotland Act 2023(1).
1.—(1) These Regulations may be cited as the Patient Safety Commissioner for Scotland Act 2023 (Commencement) Regulations 2024 and come into force on 1 May 2024.
(2) In these Regulations, “the Act” means the Patient Safety Commissioner for Scotland Act 2023.
2.—(1) Subject to paragraph (2), the day appointed for the coming into force of the provisions of the Act insofar as not already in force is 1 May 2024.
(2) The day appointed for the coming into force of paragraphs 2 and 4 of schedule 2 of the Act (public authorities legislation) is 1 September 2025.

These Regulations bring into force on 1 May 2024 all remaining provisions of the Patient Safety Commissioner for Scotland Act 2023 (“the Act”) with the exception of paragraphs 2 and 4 of schedule 2, which these Regulations bring into force on 1 September 2025.
Paragraph 2 of schedule 2 of the Act adds the Patient Safety Commissioner for Scotland (the “Commissioner”) to the list of Scottish public authorities in schedule 1 of the Freedom of Information (Scotland) Act 2002. Paragraph 4 of schedule 2 of the Act adds the Commissioner to the list of authorities in the schedule of the Public Records (Scotland) Act 2011.
The Bill for the Act received Royal Assent on 7 November 2023. Sections 21, 22, 23, 24 and 25 of the Act came into force on the following day.
