SCHEDULE 1Enabling Powers

These Regulations are made under the following powers:

(a)sections I0A(7)(1), 13C(2) (2), 53(3) and 201(1) and (3)(4) of, rules 24(5) and 37(1F)(6) of Schedule 1 and paragraphs 1(4A) and (4B) and 10 to 13(7) of Schedule 2 to, the Representation of the People Act 1983; and

(b)having regard to the definition of “prescribed” in section 202(1) of that Act, sections 10(4), 10A(1), 13A(1) and (2) and 13B(3) of, and rule 24 of Schedule 1 to, that Act(8).

Any reference to a provision which has been applied by section 1(1) of, and Schedule 1 to, the Elected Authorities (Northern Ireland) Act 1989(9) includes that provision as so applied.

The two versions of the register

The electoral registration officer makes and keeps two versions of the electoral register—the full register and the edited register.

Please indicate in your application if you wish your name to be excluded from the edited register.

The full register

The full register lists everyone who is entitled to vote. You can check it by calling at the office of Chief Electoral Officer and the offices of district councils. Only certain people and organisations can have copies of the full register, and they can only use it for specified purposes. These include electoral purposes, the prevention and detection of crime and checking your identity when you have applied for credit. The law says who can have a copy of the full register and what they can use it for. It is a criminal offence for them to pass it on to anyone else or to use it for any other purpose.

The edited register

The edited register leaves out the names and addresses of people who have asked for their names to be excluded from that version of the register. The edited register can be bought by anyone who asks for a copy and they may use if for any purpose.

Section 10A was inserted by Schedule 1 to the Representation of the People Act 2000 (“the 2000 Act”).

Section 13C was inserted by section 4 of the Electoral Fraud (Northern Ireland) Act 2002 (“the 2002 Act”).

Section 53 was amended by Schedule 4 to the Representation of the People Act 1985 (“1985 Act”) and Schedule 1 to the 2000 Act.

Section 201(3) was inserted by Schedule 1 to the 2000 Act.

Rule 24 was substituted by Schedule 6 to the 2000 Act and amended by section 3(4) of the 2002 Act.

Rule 37(1F) was inserted by section 1(2) of the Elections (Northern Ireland) Act 1985 (c. 2).

Sub-paragraphs (4A) and (4B) of paragraph 1 were inserted by section 6(2) of the 2002 Act; paragraphs 10, 10A, 10B and 11 were substituted by section 9 of the 2000 Act; paragraph 11A was inserted by Schedule 4 to the 1985 Act; and paragraph 13(1A) was inserted by section 9 of the 2000 Act.
