A draft of this Order has been laid before, and approved by resolution of, each House of Parliament in accordance with section 60(2) of the National Lottery etc. Act 1993(1).

Accordingly, the Secretary of State, in exercise of the powers conferred on him by section 28(1) of the National Lottery etc. Act 1993(2), and after consultation with Scottish Ministers, makes the following Order.

Citation and commencement

1.  This Order may be cited as the Apportionment of Money in the National Lottery Distribution Fund Order 2010 and shall come into force on the day after the day on which it is made.

Apportionment of Money in the National Lottery Distribution Fund

2.—(1) Section 22(3) of the National Lottery etc. Act 1993(3) (apportionment of money in Distribution Fund) is amended as follows with effect from the beginning of 1 April 2011.

(2) In paragraph (a) (allocation for expenditure on or connected with the arts) for “16⅔ per cent.” substitute “18 per cent.”.

(3) In paragraph (b) (allocation for expenditure on or connected with sport) for “16⅔ per cent.” substitute “18 per cent.”.

(4) In paragraph (c) (allocation for expenditure on or connected with the national heritage) for “16⅔ per cent.” substitute “18 per cent.”.

(5) In paragraph (d) (allocation for prescribed expenditure) for “50 per cent.” substitute “46 per cent.”.

3.—(1) Section 22(3) of the National Lottery etc. Act 1993 (apportionment of money in Distribution Fund) is amended as follows with effect from the beginning of 1 April 2012.

(2) In paragraph (a) for “18 per cent.” substitute “20 per cent.”.

(3) In paragraph (b) for “18 per cent.” substitute “20 per cent.”.

(4) In paragraph (c) for “18 per cent.” substitute “20 per cent.”.

(5) In paragraph (d) for “46 per cent.” substitute “40 per cent.”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the percentage apportionment of money held in the National Lottery Distribution Fund for each of the four good causes specified in section 22(3)(a) to (d) of the National Lottery etc. Act 1993.

Article 2 of this Order amends section 22(3) of the National Lottery etc. Act 1993 to provide that as from the beginning of 1 April 2011 the money held in the Distribution Fund (less such sum as the Secretary of State considers appropriate for making payments under section 31 of the National Lottery etc. Act 1993) will be apportioned as follows:

(a)18 per cent will be allocated for expenditure on or connected with each of the good causes specified in section 22(3)(a) to (c) – namely, the arts, sport and the national heritage, and

(b)46 per cent will be allocated for prescribed expenditure that is charitable or connected with health, education or the environment.

Article 3 of this Order further amends the apportionment of money in the National Lottery Distribution Fund to provide that as from the beginning of 1 April 2012 the money in the Distribution Fund (less such sum as the Secretary of State considers appropriate for making payments under section 31 of the National Lottery etc. Act 1993) will be apportioned as follows:-

(c)20 per cent will be allocated for expenditure on or connected with each of the good causes specified in section 22(3)(a) to (c), and

(a)40 per cent will be allocated for the prescribed expenditure specified in section 22(3)(d).

1993 c.39. Section 60 of the National Lottery etc. Act 1993 was amended by section 15 of the National Lottery Act 1998 (c.22) and sections 8 and 19 of the National Lottery Act 2006 (c.23).

The functions of the Secretary of State under this section, so far as they are exercisable by him in or as regards Scotland, are exercisable only after consultation with Scottish Ministers: article 4 of, and Schedule 3 to, the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 1999 (S.I. 1999/1750).

Section 22 of the National Lottery etc Act 1993 was amended by section 19 of the National Lottery Act 1998, section 1 of the National Lottery (Funding of Endowments) Act 2003 (c.23), section 34 of the Horserace Betting and Olympic Lottery Act 2004 (c.25) and sections 6 and 7 of the National Lottery Act 2006. The percentages specified in section 22(3) of the National Lottery Act etc 1993 were amended by the Apportionment of Money in the National Lottery Distribution Fund Order 1999 (S.I. 1999/344) and the Apportionment of Money in the National Lottery Distribution Fund Order 2000 (S.I. 2000/3356).
