The Secretary of State makes the following Order in exercise of the powers conferred by section 69 of the Deregulation and Contracting Out Act 1994(1).

In accordance with section 77(2) of that Act, a draft of this Order was laid before, and approved by a resolution of, each House of Parliament.

Citation and commencement

1.  This Order may be cited as the Contracting Out (Vehicle Certification and Related Functions) Order 2014 and comes into force at the end of the period of 21 days beginning with the day on which it is made.

Contracting out of functions

2.  Any function of the Secretary of State which is conferred by a provision listed in the Schedule may, subject to any limitation specified in the Schedule, be exercised by, or by employees of, such person (if any) as may be authorised to do so by the Secretary of State.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes provision to enable the Secretary of State to authorise another person, or that person’s employees, to exercise functions of the Secretary of State related to the type approval of motor vehicles and their trailers and of systems, components and separate technical units intended for such vehicles and to the approval or certification of motor engines and of devices used for the purpose of the enforcement of road traffic contraventions.

The functions to which the Order relates are conferred by the statutory provisions specified in the Schedule to the Order.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum has been prepared and is available from the Motoring Services Division at the Department for Transport, Great Minster House, 33 Horseferry Road, London SW1P 4DR. It is also published alongside this instrument on www.legislation.gov.uk.
