Coming into force in accordance with regulation 1
The Secretary of State makes these Regulations in exercise of the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972(1) and section 90A(2)(b) of the Road Traffic Offenders Act 1988(2).
The Secretary of State has been designated(3) for the purposes of section 2(2) of the European Communities Act 1972 in relation to the regulation and supervision of qualifications and working conditions of persons engaged in road transport.
These Regulations make provision for a purpose mentioned in section 2(2) of the European Communities Act 1972 and it appears to the Secretary of State that it is expedient for the reference to Regulation (EC) No 561/2006 of the European Parliament and of the Council on the harmonisation of certain social legislation relating to road transport and amending Council Regulations (EEC) No 3821/85 and (EC) No 2135/98 and repealing Council Regulation (EEC) No 3820/85(4) to be construed as a reference to that instrument as amended from time to time.
The Secretary of State has consulted such representative organisations as appear appropriate in accordance with section 90E(2)(5) of the Road Traffic Offenders Act 1988.
A draft of these Regulations has been laid before, and approved by resolution of, each House of Parliament in accordance with paragraph 2(2)(6) of Schedule 2 to the European Communities Act 1972.

Paragraph 1A of Schedule 2 was inserted by section 28 of the Legislative and Regulatory Reform Act 2006 and amended by Part 1 of the Schedule to the European Union (Amendment) Act 2008 and S.I. 2007/1388.
1988 c. 53. Section 90A was inserted by section 11(1) of the Road Safety Act 2006 (c. 49).

Section 90E(2) was inserted by section 11(1) of the Road Safety Act 2006.
