An Act to facilitate the financing of premises and equipment used by practitioners providing general medical services; to modify the prohibition of full-time salaries for practitioners providing general medical services; and for purposes connected therewith.

Remuneration of general practitionersE+W+S

10 Modification of prohibition of full-time salaried practitioner service.E+W+S

(1)The remuneration to be paid under arrangements made under [F4Part II of the M1National Health Service Act 1977] or [F5Part II] of the National Health Service (Scotland) Act [F5M21978] to a practitioner who provides general medical services shall not consist wholly or mainly of a fixed salary which has no reference to the number of patients for whom the practitioner has undertaken to provide such services, except where—

(a)the arrangements are made by virtue of [F4section 56 of the said Act of 1977] or section [F533] of the said Act of [F51978]; or

(b)the services are provided in such circumstances as may be prescribed and the practitioner consents.

(2)Before making regulations prescribing any circumstances for the purposes of this section the Minister or, as the case may be, the Secretary of State shall consult with such organisations as appear to him to be representative of the medical profession.

[F6X1(3)Section 29(4) of the M3National Health Service Act 1977 shall cease to have effect on the coming into operation of this section.]

[F7X1(3)Section 19(3) of the M4National Health Service (Scotland) Act 1978 shall cease to have effect on the coming into operation of this section.]
