(1)Subject to subsection (2) below, no information with respect to any particular undertaking which has been obtained under or by virtue of this Part of this Act shall, without the consent of the person carrying on that undertaking, be disclosed otherwise than in connection with the execution of this Part of this Act or the execution of any scheme or of any regulations under this Part of this Act.
(2)Nothing in subsection (1) above shall apply to any disclosure of information made by the Authority to the Ministers F3[, to the Scottish Ministers] or to the Secretary of State concerned with the sea fishing industry in Wales or to any of them or to any disclosure of information made for the purposes of any proceedings pursuant to this Part of this Act (including arbitrations), or any criminal proceedings, or for the purposes of any report of such proceedings as aforesaid.
(3)If any person discloses any information in contravention of this section, he shall be liable on summary conviction to imprisonment for a term not exceeding three months or to a fine not exceeding £50 or to both, or on conviction on indictment to imprisonment for a term not exceeding two years or to a fine not exceeding £100 or to both.

Any person who publishes or discloses any information obtained by him in the exercise of any power conferred by or under this Part of this Act, otherwise than for the purpose of the proper discharge of a duty in that behalf or to the Minister of Agriculture, Fisheries and Food F7[, the Scottish Ministers] or the Secretary of State, shall be liable—
(a)on conviction on indictment, to imprisonment for a term not exceeding two years or a fine not exceeding £100, or to both;
(b)on summary conviction, to imprisonment for a term not exceeding three months or to a fine not exceeding £50 or to both.

(1)This Act may be cited as the Sea Fish Industry Act 1970.
(2)This Act shall, subject to subsection (3) below, come into force on the expiration of a period of two months beginning with the date on which it is passed.
(3)The repeals by this Act of paragraph (b) and in paragraph (c) of the definition of “the Ministers” in section 33(2) of the M1Sea Fish Industry Act 1962 shall come into force upon the day appointed for the repeal of section 18 of that Act under section 23(2) of the M2Sea Fisheries Act 1968.
