22(1)In the Town and Country Planning (Amendment) Act 1972 (" the 1972 Act") section 10 (grants and loans for preservation or enhancement of character or appearance of conservation areas) shall be amended as follows.
(2)At the beginning of subsection (1) there shall be inserted " Subject to subsection (1AA) of this section ".
(3)After subsection (1) there shall be inserted—
“(1AA)Subsection (1) of this section does not apply in relation to a conservation area (or part) situated in England, but the Commission may make grants or loans for the purposes of defraying in the whole or in part expenditure incurred or to be incurred in or in connection with, or with a view to the promotion of, the preservation or enhancement of the character or appearance of any conservation area (or part) situated in England, in any case where in their opinion the expenditure in question has made or will make a significant contribution towards preserving or enhancing the character or appearance of that area or part.”
(4)In subsection (1A) for " subsection (1)" there shall be substituted " subsections (1) and (1AA) ".
(5)In subsection (2) after " Secretary of State" there shall be inserted " or (as the case may be) the Commission ".
(6)In subsection (3) for " this section " there shall be substituted " subsection (1) of this section ".
(7)After subsection (3) there shall be inserted—
“(3A)Any loan under subsection (1AA) of this section shall be made on such terms as to repayment, payment of interest and otherwise as the Commission may determine.
(3B)In this section " the Commission " means the Historic Buildings and Monuments Commission for England.”
