  8. Commissioners

    1. VI.Joint Owners or Occupiers when qualified eligible as Commissioners.

    2. VII.Same Property not to give Two Qualifications.

  9. Election and Rotation of Commissioners

    1. XVII.One Third of Commissioners elected by Ratepayers and Owners to go out of Office every Three Years.

    2. XXV.Electors to vote in Ward where their Property Qualification is situate, but not to vote for more than One Ward.

    3. XXVI.Commissioners may cause alphabetical List of Voters to be made, and may defray the Expense out-of the Rates.

    4. XXVII.Returning Officer may summon Rate Collector, &c. to attend the Election. Penalty on Rate Collector, &c. for Neglect.

    5. XXVIII.Mode of voting at Elections.

    6. XXIX.Poll may be closed if no Voting Paper be tendered for One Hour.

    7. XXX.Returning Officer to examine Poll Books and declare the Poll.

    8. XXXI.Voting Papers to be open to Inspection for Six Months after each Election.

    9. XXXII.Manner of proceeding if any Person is elected a Commissioner in more than One Ward.

    10. XXXIII.If no Election on Day appointed, it may be made on a subsequent Day.

    11. XXXIV.Election not to be void for Want of Title in presiding Officer.

    12. XXXV.Expenses of presiding Officer to be paid out of Rates levied.

  10. Meetings of Commissioners

    1. XXXVI.First Meeting of the Commissioners.

    2. XXXVII.Election of Chairmen of Meetings.

    3. XXXVIII.Manner of voting.

    4. XXXIX.Quorum of Commissioners.

    5. XL.Commissioners to hold annual and monthly Meetings.

    6. XLI.Meetings of Commissioners may be adjourned from Time to Time.

    7. XLII.Monthly Meetings shall be held for transacting the ordinary Business under this and the special Act.

    8. XLIII.No extraordinary Business shall be transacted at monthly Meetings unless Notice be given.

    9. XLIV.No Resolution of Commissioners to be revoked at a subsequent Meeting unless under certain Circumstances less under certain Circumstances.

    11. XLVI.Notice to be given of Things to be done by the Commissioners by special Order only.

  11. Contracts

    1. LVI.Power to Commissioners to enter into Contracts.

    2. LVII.Notice to be given of Contracts to the Amount of 100l. or upwards.

    3. LVIII.Commissioners may compound for Breach of Contract.

    4. LIX.As to the Conveyance of Lands by the Commissioners. Receipt under Seal to be a sufficient Discharge.

  12. Legal Proceedings

    1. LX.Commissioners not to be personally liable for Acts done in the Capacity of a Commissioner. Commissioners to be indemnified for Acts done in the Execution of their Office.

    2. LXI.Actions or Suits to be brought in the Name of any Two Commissioners or their Clerk.

    3. LXII.Executions to be levied on the Goods belonging to Commissioners by virtue of their Office only.

    4. LXIII.Commissioners and Clerk to be reimbursed all Damages, &c.

    5. LXIV.How Indictments to be preferred.

  13. Officers

    1. LXV.Power to Commissioners to appoint Clerk and other Officers, and remove them from Time to Time.

    2. LXVI.Offices of Clerk and Treasurer not to be held by the same Person.

    3. LXVII.Officer taking Fees other than those allowed to lose his Office and forfeit 50l.

    4. LXVIII.Security to be taken from all Officers intrusted with Money.

    5. LXIX.Collectors to pay over Monies within Seven Days to the Treasurer.

    6. LXX.Officers to account.

    7. LXXI.Summary Recovery against Parties failing to account.

    8. LXXII.Officers refusing to make out Account and deliver up Documents, &c. may be committed to Prison.

    9. LXXIII.Where Officer about to abscond, a Warrant may be issued in the first instance.

    10. LXXIV.Proceedings against Officers not to discharge Sureties.

  14. Mortgages

    1. LXXV.Form of Mortgage.

    2. LXXVI.Register of Mortgages to be kept, and to be open to Inspection.

    3. LXXVII.Transfers of Mortgages.

    4. LXXVIII.Register of Transfers to be kept.

    5. LXXIX.Interest on Mortgages to be paid half-yearly.

    6. LXXX.Power to borrow Money at a lower Rate of Interest to pay off Securities at a higher Rate.

    7. LXXXI.Repayment of Money borrowed at a Time and Place agreed upon.

    8. LXXXII.Repayment of Money borrowed when no Time or Place has been agreed upon.

    9. LXXXIII.Interest to cease on Expiration of Notice to pay off a Mortgage Debt.

    10. LXXXIV.Monies borrowed on Security of Rates to be paid off in a limited Period.

    11. LXXXV.Mode of paying off Mortgages.

    12. LXXXVI.Arrears of Interest, when to be enforced by Appointment of a Receiver. Arrears of Principal and Interest.

    13. LXXXVII.As to the Appointment of Receiver.

    14. LXXXVIII.Account Books to be open to the Inspection of Mortgagees

  15. Accounts

    1. LXXXIX.Accounts to be kept of Receipts and Disbursements, which shall be open for Inspection. Penalty for Refusal.

    2. XC.Statement of Accounts to be prepared and to be open for Inspection. Copies of such Statement to be furnished.

    3. XCI.Accounts to be examined and settled at the annual Meeting.

    4. XCII.Auditors to be appointed. Qualification of Auditors.

    5. XCIII.Auditors to inspect Accounts, and may appeal against Part of the same, if they think fit.

    6. XCIV.The Court may order Payment of the Costs of the Appeal.

    7. XCV.Annual Account to be made up and transmitted to the Clerk of the Peace in England or Ireland, or to the Sheriff Clerk in Scotland, and to be open to Inspection.

  16. Bye Laws

    1. XCVI.Power to make Bye Laws for regulating the Conduct of the Officers, &c. of the Commissioners.

    2. XCVII.Fines for Breach of such Bye Laws.

    3. XCVIII.Bye Laws to be so framed as that Penalties may be mitigated.

  17. Notices

    1. XCIX.Service of Notices upon Commissioners.

    2. C.Notices by Advertisement.

    3. CI.Authentication of Notices and Orders.

    4. CII.Proof of Debts in Bankruptcy.

    5. CIII.Tender of Amends

  18. Recovery of Damages and Penalties

    1. CIV.Railways Clauses Consolidation Acts, 1845, as to Damages, &c, to be incorporated with this and the special Act.

    2. CV.All Things required to be done by Two Justices in England and Ireland may in certain Cases be done by One, and in Scotland by the Sheriff, &c.

    3. CVI.Penalties, &c. imposed in respect of any Offence committed within the Metropolitan Police District to be paid to the Receiver, and applied under 2 & 3 Vict. c.71.

    4. CVII.In Ireland Part of Penalties to be paid to Guardians of Unions.

    5. CVIII.Persons giving false Evidence liable to Penalties of Perjury.

    6. CIX.Nothing in this or the special Act to affect the Rights of the Crown.

  19. Access to special Act

    1. CX.Copies of special Act to be kept by Commissioners at their Office, and deposited with the Clerks of the Peace, &c, and be open to Inspection.

    2. CXI.Penalty on Commissioners failing to keep or deposit such Copies.

    3. CXII.Act may be amended, &c.
