The London Authorities (Staff) Order 1966

The Minister of Housing and Local Government, in exercise of his powers under sections 84, 85 and 90 of the London Government Act 1963 and of all other powers enabling him in that behalf, hereby makes the following order:—

1.  This order may be cited as the London Authorities (Staff) Order 1966, and shall come into operation on 1st October 1966.

2.—(1) The Interpretation Act 1889 applies to the interpretation of this order as it applies to the interpretation of an Act of Parliament.

(2) In this order—

officerincludes the holder of any place, situation or employment;

specified council” means a council abolished by section 3(1)(b) of the London Government Act 1963, the Common Council of the City of London, the county council of Essex, Hertfordshire, Kent or Surrey or the urban district council of Chigwell.

3.  Article 4 shall apply—

(a)where any person employed in the removal or disposal of refuse who was excepted from the operation of article 5(1) of the London Authorities (Staff) Order 1965(1) under the proviso added thereto by article 45 of the London Government Order 1965(2) (and was therefore transferred by article 8 of the first-mentioned order to the employment of a London borough council or remained in the employment of the Common Council of the City of London) immediately after leaving such employment enters the employment of the Greater London Council in the removal or disposal of refuse; and

(b)where any officer of a specified council who was transferred by the London Authorities (Staff) Order 1965 to the employment of a London borough council which as from 1st April 1965 had combined or made other arrangements in common with another weights and measures authority as mentioned in section 37(1) of the Weights Act 1963 (or who had been appointed by such a London borough council to hold a place, situation or employment in the weights and measures service before or as from 1st April 1965), on a variation or the termination of the combination or other arrangements (or of any combination or other arrangements in common replacing earlier such combination or other arrangements on a variation or the termination thereof) before 1st April 1985, with the consent of the London borough council in whose employment he is immediately before such variation or termination enters (or has before the coming into operation of this order entered) the employment of another London borough council.

4.  Every officer entering (or having entered) the employment of any authority as specified in article 3 shall, so long as he continues in that employment by virtue of the contract under which he enters (or has entered) therein, enjoy terms and conditions of employment not less favourable than those he enjoyed immediately before 1st April 1965:

Provided that this paragraph shall apply to the scale of the salary or remuneration of the officer only so long as he is engaged in duties reasonably comparable to those in which he was engaged immediately before 1st April 1965.

Any question whether duties are reasonably comparable as aforesaid shall be determined by a tribunal established under section 12 of the Industrial Training Act 1964.

5.  In the London Authorities (Superannuation) Order 1965(3), in article 3 (Definition of transferred employee) the following item shall be added—

(cc)any officer entering (or having entered) the employment of any authority as specified in (a) or (b) of article 3 of the London Authorities (Staff) Order 1966,.

EXPLANATORY NOTE

This Order makes provision for the protection of interests of certain persons employed in the removal or disposal of refuse, or in the weights and measures service, whose position was affected by the London Government Act 1963.
