The Local Government (Successor Parishes) (No. 2) Order 1973

The Secretary of State for the Environment, upon consideration of proposals made to him by the Local Government Boundary Commission for England and in exercise of the powers conferred upon him by paragraph 2(1) of Part V of Schedule 1 to the Local Government Act 1972 and of all other powers enabling him in that behalf, hereby makes the following order:—

Title, commencement and interpretation

1.  This order may be cited as the Local Government (Successor Parishes) (No. 2) Order 1973 and shall come into operation on 17th December 1973.

2.  The Interpretation Act 1889 shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

Successor parishes

3.  There shall be constituted the parishes named in column (1) of the Schedule to this order, the boundaries of which are coterminous with the boundaries of the existing urban districts or boroughs respectively specified in respect of such parishes in column (2).

Parish councillors

4.  In relation to the parishes named in the said column (1), 17th December 1973 is hereby specified as the date for the purposes of sub-paragraphs (2) (aldermen and councillors of boroughs or councillors of urban districts to be parish councillors) and (5) (cessation of provision suspending elections, and filling of casual vacancies) of paragraph 13 of Schedule 3 to the Local Government Act 1972.

EXPLANATORY NOTE

Part V of Schedule 1 to the Local Government Act 1972 makes provision for the constitution of parishes for areas of existing boroughs and urban districts in England. A number of parishes were constituted by the Local Government (Successor Parishes) Order 1973 (S.I. 1973/1110). This Order gives effect to further proposals made by the Local Government Boundary Commission for England. It also specifies a date for certain electoral provisions of the 1972 Act (see Article 4).
