The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purposes of section 2(2) of the European Communities Act 1972 in relation to measurements of cereals for import and export purposes, acting jointly in exercise of the powers conferred upon them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following regulations:—

1.  These regulations may be cited as the Measurements of Cereals for Import and Export Purposes (Amendment) Regulations 1976 and shall come into operation on 12th April 1976.

2.  The Interpretation Act 1889 shall apply to the interpretation of these regulations as it applies to the interpretation of an Act of Parliament.

3.  In the definition of “the Community provisions” in regulation 2(1) of the Measurements of Cereals for Import and Export Purposes Regulations 1975(2) the words “and any instrument replacing, supplementing or further amending that directive” are hereby revoked.

EXPLANATORY NOTE

The Measurements of Cereals for Import and Export Purposes Regulations 1975 provided for the adoption for the purpose of trade in cereals between the United Kingdom and other Member States of the European Economic Community of the unit of measurement known as the EEC standard mass per storage volume as defined in “the Community provisions”. For this purpose “the Community provisions” were defined as “Council Directive No. 71/347EEC on the approximation of the laws of Member States relating to the measuring of the standard mass per storage volume of grain, as amended(3), and any instrument replacing, supplementing or further amending that directive” These Regulations revoke the italicised words in that definition.
