The Counsellors of State in Council

Whereas Her Majesty, in pursuance of the Regency Acts 1937 to 1953, was pleased, by Letters Patent dated the 21st day of July 1978, to delegate to the six Counsellors of State therein named or any two or more of them full power and authority during the period of Her Majesty's absence from the United Kingdom to summon and hold on Her Majesty's behalf Her Privy Council and to signify thereat Her Majesty's approval for anything for which Her Majesty's approval in Council is required:

And whereas a draft of this Order has been laid before Parliament in accordance with section 1 of the European Communities Act 1972 and has been approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty Queen Elizabeth The Queen Mother and Her Royal Highness The Princess Margaret, Countess of Snowdon, being authorised thereto by the said Letters Patent, and in pursuance of the powers conferred by section 1(3) of the European Communities Act 1972 and all other powers enabling Her Majesty, do hereby, by and with the advice of Her Majesty's Privy Council, on Her Majesty's behalf order, and it is hereby ordered, as follows:—

1.  This Order may be cited as the European Communities (Definition of Treaties) (No. 6) (International Development Association) Order 1978. It shall come into operation in respect of the treaty specified in the Schedule to this Order on the date on which the treaty enters into force for the United Kingdom. This date will be notified in the London, Edinburgh and Belfast Gazettes.

2.  The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

3.  The treaty specified in the Schedule to this Order is to be regarded as a Community Treaty as defined in section 1(2) of the European Communities Act 1972.

SCHEDULE

Agreement between the European Economic Community, its Member States and the International Development Association, signed on 2 May 1978 at Brussels (Cmnd. 7256).

EXPLANATORY NOTE

This Order declares the Agreement of 2nd May 1978 between the European Economic Community, its Member States and the International Development Association to be a Community Treaty as defined in section 1(2) of the European Communities Act 1972. The principal effect of declaring this Agreement to be a Community Treaty as so defined is to bring into play, in relation to that Agreement, the provisions of section 2 of the European Communities Act 1972 and so to provide authority for payment by the United Kingdom of the contributions required under the Agreement.
