PETROLEUM CONTINENTAL SHELF OFFSHORE INSTALLATIONS

The Oil and Gas (Enterprise) Act 1982 (Commencement No. 3) Order 1982

7th October 1982

The Secretary of State, in exercise of his powers under section 38(2) of the Oil and Gas (Enterprise) Act 1982 (hereinafter referred to as “the Act”) and of all other powers enabling him in that behalf, hereby makes the following Order:—

1.  This Order may be cited as the Oil and Gas (Enterprise) Act 1982 (Commencement No.3) Order 1982.

2.  The provisions of the Act specified in Schedule 1 hereto shall come into force on 1st November 1982.

3.  The provisions of the Act specified in Schedule 2 hereto shall come into force on 31st December 1982.

4.  The provisions of the Act specified in Schedule 3 hereto shall come into force on 1st April 1983.

SCHEDULE 1PROVISIONS COMING INTO FORCE ON 1ST NOVEMBER 1982

Section 7.Borrowing powers etc of the British National Oil Corporation.
Section 24.Extended meaning of “offshore installation” in section 1 of the Mineral Workings (Offshore Installations) Act 1971.
Section 26.Extended application of the Offshore Petroleum Development (Scotland) Act 1975.
Section 34.Application of the Trustee Investments Act 1961.
Section 37, so far as it relates to the provisions of Schedules 3 and 4 specified in this Schedule.Amendments and repeals.
Schedule 3, paragraphs 7 to 11, 23, 26, 28, and 30 to 33.Minor and consequential amendments.
Schedule 4, so far as it relates to repeals of sections 6(2) and 12(1) of the Mineral Workings (Offshore Installations) Act 1971, and sections 1(3)(c), 3(3), 44(1) to (4), and 45(3) of the Petroleum and Submarine Pipe-lines Act 1975.Repeals.

SCHEDULE 2PROVISIONS COMING INTO FORCE ON 31ST DECEMBER 1982

Section 4.New financial structure of the British National Oil Corporation.
Section 5.Payments by the Oil Corporation to the Secretary of State.
Section 6.Grants by the Secretary of State to the Oil Corporation.
Section 23, subsections (2), (3), (4) and (6), so far as is necessary for the purposes of the amendments to the Social Security Act 1975, the Patents Act 1977 and the Social Security and Housing Benefits Act 1982 herein effected.Application of civil law.
Section 37, so far as it relates to the provisions of Schedules 3 and 4 specified in this Schedule.Amendments and repeals.
Schedule 3, paragraphs 21, 27, 39 and 44.Minor and consequential amendments.
Schedule 4, so far as it relates to repeals of sections 2(4)(d), 7(2), 14(4)(b) and 40(2)(a) and (c) and (3)(a) and (c) of the Petroleum and Submarine Pipe-lines Act 1975.Repeals.

Article 4

SCHEDULE 3PROVISIONS COMING INTO FORCE ON 1ST APRIL 1983

Provisions of the ActSubject matter of provision
Section 8.Abolition of the National Oil Account.
Section 37, so far as it relates to the provisions of Schedule 4 specified in this Schedule.Amendments and repeals.
Schedule 4, so far as it relates to repeals of section 40(1), (3) and (4) of the Petroleum and Submarine Pipe-lines Act 1975.Repeals.

EXPLANATORY NOTE

This Order brings further provisions of the Oil and Gas (Enterprise) Act 1982 into force. The provisions specified in Schedule 1 to the Order (comprising one provision of Part I (oil), certain provisions of Part IV (offshore activities), one provision of Part V (miscellaneous and general), and certain provisions in Schedules 3 and 4) are brought into force on 1st November 1982; those specified in Schedule 2 to the Order (comprising further provisions of Part I (oil) and related provisions in Schedules 3 and 4) are brought into force on 31st December 1982; and those specified in Schedule 3 to the Order (the remaining provision of Part I (oil) and related provisions in Schedule 4) are brought into force on 1st April 1983.

NOTE AS TO EARLIER COMMENCEMENT ORDERS

The following provisions of the Act have been brought into force by commencement orders made before the date of this Order:—
