ATOMIC ENERGY AND RADIOACTIVE SUBSTANCES

NUCLEAR INSTALLATIONS

The Energy Act 1983 (Commencement No. 1) Order 1983

Made

23rd May 1983

The Secretary of State, in exercise of his powers under section 37(1) and (2) of the Energy Act 1983 (hereinafter called “the Act”), and of all other powers enabling him in that behalf, hereby makes the following Order:—

1.  This Order may be cited as the Energy Act 1983 (Commencement No. 1) Order 1983.

2.—(1) The following provisions of the Act, namely—

(a)Part I (except sections 21 and 22),

(b)Part III (except paragraph (b) of section 35 and section 37(3)),

(c)Schedules 1 and 3, and

(d)the repeals in Part I of Schedule 4 specified in the Appendix to this Order,

shall, subject to paragraph (2) of this Article, come into force on 1st June 1983.

(2) The following transitional provisions and savings shall have effect—

(a)in relation to paragraph 9 of Schedule 1 to the Act, section 53 of the Schedule to the Electric Lighting (Clauses) Act 1899(1) shall continue to have effect without amendment for the purposes of any connection or disconnection of a meter effected prior to 1st June 1983.

(b)in relation to paragraph 13 of Schedule 1 to the Act, any question which has been referred to a meter examiner under the provisions of section 57 of the Schedule to the Electric Lighting (Clauses) Act 1899(2) prior to 1st June 1983, but which could not be so referred after that date, shall be determined by the meter examiner notwithstanding the amendment to section 57; and

(c)in relation to paragraph 17(4) of Schedule 1 to the Act, and to the repeal of subsections (5) to (8) of section 30 of the Electricity Act 1957, the said subsections (5) to (8) shall continue to have effect for the purposes of offences committed prior to 1st June 1983.

3.  The following provisions of the Act, namely—

(a)sections 21 and 22,

(b)Part II,

(c)paragraph (b) of section 35 and section 37(3),

(d)Schedule 2, and

(e)Part II of Schedule 4,

shall come into force on 1st September 1983.

EXPLANATORY NOTE

This Order brings into force on 1st June 1983 the provisions of the Energy Act 1983 relating to electricity generation and supply, being those of Parts I and III (except for sections 21 and 22 and Schedule 2, which relate to the Electricity Consumers' Council, and section 37(3), which relates to nuclear installations) and of Schedules 1 and 3 and (with certain exceptions) Part I of Schedule 4.

The Order also brings into force on 1st September 1983 the provisions of the Act relating to the Electricity Consumers' Council, namely sections 21 and 22 and Schedule 2, and to nuclear installations, namely the provisions of Part II, section 37(3), and Part II of Schedule 4.
