The Secretary of State for Transport, in exercise of the powers conferred by section 43(2) and (6) of the Road Traffic Act 1972(1) and now vested in him(2), and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of that Act, hereby makes the following Regulations:—

1.  These Regulations shall come into operation on 1st August 1984 and may be cited as the Motor Vehicles (Tests) (Amendment) (No. 3) Regulations 1984.

2.  The Motor Vehicles (Tests) Regulations 1981(3) are amended in accordance with the following provisions of these Regulations.

3.  In Regulation 3, in paragraph (1), for the definition of “the Lighting Regulations” substitute the following definition:—

“the Lighting Regulations” means the Road Vehicles Lighting Regulations 1984(4).

4.  In Regulation 20, in paragraph (7)(c), for sub-paragraphs (iii) and (iv) substitute the following sub-paragraphs:—

(iii)the Lighting Regulations, Regulation 16, Schedule 1, item 1, and Schedule 11, Part I (obligatory rear fog lamps) and Regulation 17 and Schedule 11, Part II (optional rear fog lamps); and

(iv)the Lighting Regulations, Regulation 17 and Schedule 13 (reversing lamps)..

5.  In Schedule 2:—

(a)in item 1 (The Lighting Requirements), for the entry in column (2)(b) substitute the following entry:—

The requirements specified in the following provisions of the Lighting Regulations:—

  • Regulation 16 and Schedule 1, item 1 or 2, and Schedule 2, Part I (obligatory front position lamps);

  • Regulation 16 and Schedule 1, item 1 or 2 and Schedule 4, Part I (dipped beam headlamps);

  • Regulation 16 and Schedule 1, item 1 or 2 and Schedule 5, Part I (main-beam headlamps);

  • Regulation 16 and Schedule 1, item 1 or 2, and Schedule 10, Part I (obligatory rear position lamps);

  • Regulation 16, Schedule 1, item 1 or 2, and Schedule 17, Part I (obligatory rear reflex reflectors).;

(b)in item 2 (The Stop Lamp Requirements), for the entry in column (2)(b) substitute the following entry:—

The requirements specified in the following provisions of the Lighting Regulations:—

  • Regulation 16, and Schedule 1, item 1 or 2 and Schedule 12, Part I (obligatory stop lamps).;

(c)in item 3 (The Direction Indicator Requirements) for the entry in column (2)(b) substitute the following entry:—

The requirements specified in the following provisions of the Lighting Regulations:—

  • Regulation 16, and Schedule 1, item 1 or 2 and Schedule 7, Parts I and II (obligatory direction indicators); and

(d)in item 12, in column (2)(b)—

(i)for sub-paragraph (c) substitute the following sub-paragraph:—

(c)The requirements specified in the Lighting Regulations, Regulation 16, Schedule 1, item 1 and Schedule 11, Part I (obligatory rear fog lamps) and Regulation 17 and Schedule 11, Part II (optional rear fog lamps);; and

(ii)for sub-paragraph (e) substitute the following sub-paragraph:—

(e)The requirements specified in the Lighting Regulations, Regulation 17 and Schedule 13 (reversing lamps);.

6.  In Schedule 3—

(a)in Part 1—

(i)for paragraph 1(b) substitute the following—

(b)the said lamps are clean and in good working order and the said reflectors are unobscured and in good condition, and;

(ii)in paragraph 2, for sub-paragraph (1) substitute the following sub-paragraph:—

(1) Where the vehicle is one which the lighting requirements require to be equipped with a headlamp, the vehicle shall be examined in order to determine whether every main-beam headlamp is constructed so that the light emitted from it—

(a)can be deflected at the will of the driver to become a dipped beam, or

(b)can be extinguished by the operation of a device which at the same time either—

(i)causes the lamp to emit a dipped beam, or

(ii)causes another lamp to emit a dipped beam;; and

(iii)in paragraph 2, in sub-paragraph (2), omit the words “which would be emitted from that lamp if it were to be used to show a light to the front in the circumstances specified in sub-paragraph (2)”;

(b)in Part II, in paragraph 3(b), for the word “efficient” substitute the words “in good working order”; and

(c)in Part III, in paragraph 4(b), for the word “efficient” substitute the words “in good working order”.

These Regulations amend the Motor Vehicles (Tests) Regulations 1981 to up-date provisions in consequence of the Road Vehicles Lighting Regulations (S.I. 1984/812).
