The Control of Pesticides (Advisory Committee On Pesticides) (Terms of Office) Regulations 1985

The Minister of Agriculture, Fisheries and Food and the Secretary of State, acting jointly, in exercise of the powers conferred on them by section 16(7) of and paragraphs 3 and 8 of Schedule 5 to the Food and Environment Protection Act 1985 and of all other powers enabling them in that behalf, hereby make the following regulations:—

Title, commencement and interpretation

1.—(1) These regulations may be cited as the Control of Pesticides (Advisory Committee on Pesticides) (Terms of Office) Regulations 1985, and shall come into operation on 31st October 1985.

(2) In these regulations—

the committee” means the Advisory Committee on Pesticides established by the Control of Pesticides (Advisory Committee on Pesticides) Order 1985;

the Ministers” means the Minister of Agriculture, Fisheries and Food and the Secretary of State, acting jointly.

Terms of office

2.  The members of the committee, who shall number as many as the Ministers may from time to time determine, and the person appointed as chairman, shall hold and vacate office on the following terms:

(a)they shall be appointed for a term not exceeding three years, which shall end on the 31st December of its final year;

(b)they may be re-appointed for a further term or terms; and

(c)their appointment shall be subject to their signing a declaration to the effect that they have no such financial or commercial interest as would be likely to prejudice the proper discharge of their functions.

EXPLANATORY NOTE

These regulations provide for the terms on which the chairman and members of the Advisory Committee on Pesticides, established for the purpose of advising the government on matters relating to pest control, are to hold and vacate their offices.
