The Minister of Agriculture, Fisheries and Food and the Secretaries of State concerned with sea fishing in Scotland, Northern Ireland and Wales respectively, in exercise of the powers conferred by sections 2(1) and 6(2) of the Fishery Limits Act 1976 and now vested in them(1) and of all other powers enabling them in that behalf, hereby make the following order:—
1. This order may be cited as the Fishing Boats (European Economic Community) Designation (Variation) Order 1986 and shall come into operation on 31st March 1986.
2. The Fishing Boats (European Economic Community) Designation Order 1983 shall be varied by adding, in the appropriate columns of the Schedule thereto after the entries relating to the Netherlands, the following countries, areas and descriptions of sea fish:—
Portugal | Any part of British fishery limits outside 12 miles from the baselines | All descriptions of sea fish |
Spain | Any part of British fishery limits outside 12 miles from the baselines | All descriptions of sea fish. |

This order varies the Fishing Boats (European Economic Community) Designation Order 1983 which designates member States and the areas within British fishery limits within which, and descriptions of sea fish for which, fishing boats registered in each member State may fish, for the purposes of section 2(1) of the Fishery Limits Act 1976. The order adds Portugal and Spain to the list of designated member States, pursuant to the accession of those countries to membership of the European Economic Community, and specifies the areas and descriptions of sea fish which are designated in relation to those countries.
The designation of Portugal and Spain effected by this order is for the purposes only of the Fishery Limits Act 1976. The provisions of the instrument of accession — the Act annexed to the Treaty concerning the accession of the Kingdom of Spain and the Portuguese Republic to the European Economic Community and the European Atomic Energy Community (Cmnd. 9634) — restrict the access of vessels flying the flag of Portugal or of Spain to certain zones only of the waters under the sovereignty or within the jurisdiction of the other member States.
