The Police Federation (Amendment) Regulations 1987

In exercise of the powers conferred on me by section 44 of the Police Act 1964(1), and after consultation with the three Central Committees of the Police Federation for England and Wales sitting together as a Joint Committee, I hereby make the following Regulations:—

1.  These Regulations may be cited as the Police Federation (Amendment) Regulations 1987 and shall come into force on 1st August 1987.

2.—(1) In paragraph (4)(h) of regulation 19 of the Police Federation Regulations 1969(2), there shall be substituted for the words from “offence under the Road Traffic Act 1960” to the word “blood” the words “offence under the Road Traffic Act 1972 or any other enactment relating to road traffic, other than offences under sections 5, 6, 7, 8 or 19 of that Act or section 12 of the Licensing Act 1872 (offences of driving or being in charge when impaired by drink or drugs and of driving, etc. with an undue proportion of alcohol in the blood)”.

(2) For paragraph (5) of that regulation there shall be substituted the following provisions:—

(5)  Federation funds held by the joint central committee or, with the consent thereof, funds held by a central committee, may, on such terms and conditions as may be specified by the joint central committee in the circumstances of a particular case, and with the prior approval of the joint central committee, be used to defray legal charges incurred by such a person as is mentioned in paragraph (4)(h) in connection with criminal proceedings brought against him for causing the death of or injury to any person, or for any assault, committed as mentioned in paragraph (4)(h).

(5A)  In paragraph (5) “injury” includes any impairment of a person’s physical or mental condition..

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Police Federation Regulations 1969. Regulation 2(1) brings up to date references in regulation 19(4) of the 1969 Regulations to those driving offences in respect of which central funds of the Federation may be used in paying legal charges incurred by a member or former member of the Federation. Regulation 5(2) permits central funds of the Federation to be used, by or with the consent of the joint central committee, in paying legal charges incurred by a member or former member of the Federation in connection with criminal proceedings brought against him for causing death or injury to any person or for any assault. The joint central committee is empowered to impose terms and conditions on the use of funds for this purpose and its prior approval is required.

The Regulations come into force on 1st August 1987.
