The Minister of Agriculture, Fisheries and Food, in exercise of the power conferred by section 11 of the Animal Health Act 1981(1)and of all other powers enabling him in that behalf, hereby makes the following order:—
1. This Order may be cited as the Export of Sheep (Prohibition) (Amendment) Order 1987 and shall come into force on 27th February 1987.
2. The Export of Sheep (Prohibition) Order 1987(2) is hereby amended by substituting for article 2(4) the following paragraph:—
“(4) Paragraph (2)(a) above shall not apply in the case of—
(a)any sheep which has been examined and marked with an ear-tag by a person authorised in that behalf by the appropriate Minister; or
(b)any sheep which was marked with a blue mark.”.
In witness whereof the Official Seal of the Minister of Agriculture, Fisheries and Food was hereunto affixed on 22nd February 1987.

This Order amends the Export of Sheep (Prohibition) Order 1987 (“the principal Order”) which prohibits, subject to an exception, the export from Great Britain to a member State of the European Communities of—
(a)sheep moved from a place in an area designated for the purposes of Part I of the Food and Environment Protection Act 1985 in accordance with the terms of a consent under section 2(1) of that Act which required that the sheep to which it applies should be marked in a specified manner; and
(b)sheep which have been moved in contravention of a restriction imposed by an order made under section 1 of that Act.
The principal Order does not apply to those sheep which have been examined and subsequently marked with an ear-tag by an officer authorised by the Minister of Agriculture, Fisheries and Food or the Secretary of State for Scotland or Wales. This Order extends that exception to any sheep moved from a place in a designated area in accordance with the terms of a consent which required it to be marked with a blue paint mark.
