BROADS AUTHORITY

Norfolk and Suffolk Broads Act 1988 (Commencement) Order 1988

The Secretary of State, being satisfied that at least 27 of the initial appointments of members of the Broads Authority under section 1(3)(a) and (b) of the Norfolk and Suffolk Broads Act 1988(1) have been effected, in exercise of the powers conferred on him by paragraph 1(3) of Schedule 7 to that Act, and in exercise of the powers conferred on him by section 26(3) and (4) of that Act, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Norfolk and Suffolk Broads Act 1988 (Commencement) Order 1988.

(2) In this Order “the Act” means the Norfolk and Suffolk Broads Act 1988.

Commencement of provisions

2.  The date specified for the purposes of paragraph 1 of Schedule 7 to the Act is 6th June 1988.

3.  Sections 18, 19 and 21 (except so far as it gives effect paragraphs 1, 3, 5, 11 and 21 of Schedule 6) of the Act shall come into force on 6th June 1988.

4.  Sections 13, 20, 22 and all other provisions of the Act not then in force shall come into force on 1st April 1989.

Explanatory Note

(This note is not part of the Order)

Article 2 of this Order specifies 6th June 1988 as the date on which the Broads Authority, created by section 1 of the Norfolk and Suffolk Broads Act 1988, shall be deemed to be duly constituted. By section 26(2) of the Act, section 9 (the Navigation Committee) and sections 14 to 17 (which relate to finance) of that Act are brought into force on the same date.

Article 3 provides that sections 18, 19 and 21 (in relation to the provisions of Schedule 6 other than those specified in the article) shall also come into force on 6th June 1988.

Article 4 of this Order provides that the provisions of the Act not then in force shall come into force on 1st April 1989, which will by virtue of section 25(1) be the operative date for the purposes of the Act.
