The Secretary of State for Social Security, in exercise of the powers conferred by section 30(1) of, and paragraph 2(6) of Schedule 8 to the Social Security Act 1989(1) and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee that the proposals to make these Regulations should not be referred to it(2), hereby makes the following Regulations:
1. These Regulations may be cited as the Social Security (Local Councillors) Amendment Regulations 1990 and shall come into force on 1st August 1990.
2. In paragraph (3) of regulation 3 of the Social Security (Severe Disablement Allowance (Amendment) and Local Councillors Consequential) Regulations 1989(3) (treatment of a local councillor’s allowance paid otherwise than weekly) for the words “In the case of a special responsibility allowance,” there shall be substituted the words “In the case of a basic allowance or a special responsibility allowance,”.

These Regulations amend the Social Security (Severe Disablement Allowance (Amendment) and Local Councillors Consequential) Regulations 1989. They provide for the calculation of a councillor’s basic allowance for the purposes of severe disablement allowance, sickness benefit, invalidity benefit or an invalidity pension under section 15 or section 16 of the Social Security Pensions Act 1975 (c. 60). They are made as a consequence of the amendment to Schedule 8 to the Social Security Act 1989 by Schedule 11 to the Local Government and Housing Act 1989. That Act introduced a basic allowance for councillors which is payable in addition to an attendance allowance and a special responsibility allowance.
1989 c. 24. Section 30(1) is cited for the meaning it ascribes to “regulations”. Paragraph 2(6) of Schedule 8 was amended by paragraph 113 of Schedule 11 to the Local Government and Housing Act 1989 (c. 42).
See the Social Security Act 1986 (c. 50), section 61(1)(b) and (10); the Social Security Act 1989, Schedule 8, added a definition of “regulations” to section 61(10) of the Act of 1986.
