Explanatory Note

(This note is not part of the Regulations)

These Regulations replace the scale of building control fees in the Building (Procedure) (Scotland) Regulations 1981. The average increase is approximately one-third. Demolition warrant fees are now included in paragraph 1(a) of the table of fees and are charged on a sliding scale rather than at a fixed rate, as was previously the case. In addition, a fixed fee is now payable in respect of all applications for extension of a period of a warrant, not only in respect of those applications relating to limited life buildings.

(1)

1959 c. 24; section 20 was substituted by the Housing (Scotland) Act 1986 (c. 65), section 19(6); section 29(1) contains a definition of “prescribed” relevant to the exercise of the statutory powers under which these Regulations are made.

(2)

S.I. 1981/1499, as amended by S.I. 1987/1232 and 1988/2194.
