TERMS AND CONDITIONS OF EMPLOYMENT

The Time Off for Public Duties Order 1990

The Secretary of State, in exercise of the powers conferred on him by sections 29(5)(a) and 154 of the Employment Protection (Consolidation) Act 1978(1), hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Time Off for Public Duties Order 1990 and shall come into force on 15th October 1990.

Addition of boards of visitors and visiting committees

2.  Section 29(1) of the Employment Protection (Consolidation) Act 1978 shall be modified by inserting the following paragraph after paragraph (c) —

(cc)a member of, in England and Wales, a board of visitors appointed under section 6(2) of the Prison Act 1952(2) or, in Scotland, a visiting committee appointed under section 19(3) of the Prisons (Scotland) Act 1989(3) or constituted by virtue of rules made under section 39, as read with section 8(1), of that Act;

Explanatory Note

(This note is not part of the Order)

Section 29 of the Employment Protection (Consolidation) Act 1978 requires an employer to allow time off during working hours, subject to the provisions of the section, to an employee of his who is a justice of the peace, member of a local authority or member of certain other bodies specified in subsection of the section.

This Order modifies section 29(1) by adding boards of visitors for prisons, remand centres and young offender institutions, in England and Wales, and visiting committees for prisons, remand centres and young offenders institutions, in Scotland, to the list of bodies whose members are covered by the section.

1952 c. 52; section 6 was amended by the Courts Act 1971 (c. 23), section 53, Schedule 11 Part IV, and its application is extended by section 43(4) of the Prison Act 1952, as substituted by the Criminal Justice Act 1982 (c. 48), section 11, and as further amended by the Criminal Justice Act 1988 (c. 33), section 123(6), Schedule 8 paragraph 1.
