The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 6(3) and 15(6) and (7) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Competition) (England) (Amendment) Regulations 1991 and shall come into force on 7th October 1991.
2. Regulation 2(2) of the Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1990(2) is amended by substituting for the definition of “EW” the following:
“EW = the gross cost of the specified work carried out or treated as carried out by or for the authority in the corresponding period in the financial year ending on 31st March 1991, estimated by the authority on the assumption that costs are incurred at a constant rate over the year;”.

Regulation 2 of the Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1990 provides that section 6 of the Local Government Act 1988 (restrictions on carrying out functional work) shall apply where certain authorities propose to carry out the activity of managing sports and leisure facilities on or after specified dates. In the period beginning on 1st January 1992 and ending on 31st July 1992, and the period beginning on 1st August 1992 and ending on 31st December 1992, that section applies to work to the value of the product of the formula set out in regulation 2(2) of those Regulations.
These Regulations amend one of the factors in the formula set out in that regulation.
