The Disability Living Allowance And Disability Working Allowance Act 1991 (Commencement No. 2) Order 1991

The Secretary of State for Social Security, in exercise of powers conferred by section 15(2) of the Disability Living Allowance and Disability Working Allowance Act 1991(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Disability Living Allowance and Disability Working Allowance Act 1991 (Commencement No. 2) Order 1991.

(2) In this Order, unless the context otherwise requires, references to sections and Schedules are references to sections of and Schedules to the Disability Living Allowance and Disability Working Allowance Act 1991.

Appointed days

2.  The day appointed for the coming into force of—

(a)section 5 (regulations relating to the substitution of disability living allowance for attendance allowance and mobility allowance) and section 11 (supplementary provisions), is 19th November 1991.

(b)the sections and Schedules specified in the Schedule to this Order for the purposes only of authorising the making under the Social Security Act 1975(2), the Social Security (Miscellaneous Provisions) Act 1977(3) or the Social Security Act 1986(4), as amended by those sections and Schedules, of regulations which are expressed to come into force on or after 3rd February 1992, is 19th November 1991;

(c)sections 1 and 2(1) and Schedules 1 and 2 and section 4 in so far as it relates to those Schedules, for the purposes only of—

(i)the making of claims for and the fdetermination of claims and questions relating to, disability living allowance, and

(ii)the making by persons who will have attained the age of 65 on 6th April 1992 of claims for, and the determination of claims and questions relating to, attendance allowance,

is 3rd February 1992;

(d)Schedule 1, paragraphs 10 to 12, 14 to 16 and 20, Schedule 2, paragraphs 2, 6, 7, 10, 19 and 22 (all of which relate either to Disability Appeal Tribunals or the Disability Living Allowance Advisory Board) and section 4 in so far as it relates to them, is 3rd February 1992;

(e)sections 6, 7 and 9 and Schedule 3, for the purposes only of making claims for, and the determination of claims and questions relating to, disability working allowance is 10th March 1992;

(f)sections 1, 2, 4 and 6 to 10 and Schedules 1 to 4, except Schedule 2, paragraph 16, in so far as not already in force, is 6th April 1992; and

(g)Schedule 2, paragraph 16 (up-rating) and section 4 in so far as it relates to it, is 1st May 1992.

Explanatory Note

(This note is not part of the Order)

This Order brings into force all remaining provisions of the Disability Living Allowance and Disability Working Allowance Act 1991 (c. 21). The commencement dates are—

(a)19th November 1991 for the powers enabling Regulations to be made;

(b)3rd February 1992 for the purpose of making claims for, and the determination of claims and questions relating to, disability living allowance, and attendance allowance where the person has attained the age of 65;

(c)10th March 1992 for the purpose of making claims for, and the determination of claims and questions relating to, disability working allowance;

(d)6th April 1992 for all remaining purposes, apart from up-rating;

(e)1st May 1992, for up-rating.
