The Weights and Measures (Packaged Goods) (Amendment) Regulations 1992

The Secretary of State in exercise of the powers conferred on him by sections 47(1), 49(1)(a) and (b), 66, 86 and 94(1) of the Weights and Measures Act 1985(1) and of all other powers enabling him in that behalf hereby makes the following Regulations:—

1.  These Regulations may be cited as the Weights and Measures (Packaged Goods) (Amendment) Regulations 1992 and shall come into force on 1st January 1993.

2.  The Weights and Measures (Packaged Goods) Regulations 1986(2) are hereby amended in Schedule 4,—

(a)in paragraph 1(1), after head (a), by the addition of the following head—

(aa)“the 1992 Regulations” mean the Non-automatic Weighing Instruments (EEC Requirements) Regulations 1992(3);;

(b)in paragraph 1(1)(b)(ii), after the words “United Kingdom”, by the addition of the words “or an EC type-approval certificate within the meaning of the 1992 Regulations”;

(c)for paragraph 1(1)(c), by the substitution of the following head—

(c)in relation to weighing equipment, ‘approved minimum load’—

(i)in the case of weighing equipment of an approved pattern, means the minimum load for which the pattern has been approved, and

(ii)in the case of a non-automatic weighing instrument, means the minimum load for which the type has been granted approval;

(d)in paragraph 1(1)(d), at the end by the omission of the word “and” and, in paragraph (1)(e), at the end by the addition of the word “and”;

(e)after paragraph 1(1)(e), by the addition of the following head—

(f)‘non-automatic weighing instrument’ means a non-automatic weighing instrument which is for the time being of an approved type within the meaning of the 1992 Regulations..

(f)in paragraph 2, after the words “Directive 73/360/EEC,”, by the addition of the words “or which bears the sticker defined in regulation 2(1) of the 1992 Regulations,”;

(g)in paragraph 2(1)(c) and (d) and (2)(b), after the words “machine of an approved pattern” in each place where they occur, by the addition of the words “or a non-automatic weighing instrument, in either case”;

(h)in paragraph 2(2), in the Note to Table 3: BEAM SCALES, after the words “that Directive”, by the addition of the words

(a)to Class B machines include references to beam scales marked with the symbol

or

; and

(b)to Class C machines include references to beam scales marked with the symbol

or

in accordance with Council Directive No. 90/384/EEC(4)..

(i)in paragraph 7, after the word “verification”, by the addition of the words “or the sticker defined in regulation 2(1) of the 1992 Regulations,”;

(j)in paragraph 7(1)(b) and (c), after the words “machine of an approved pattern” in each place where they occur, by the addition of the words “or a non-automatic weighing instrument, in either case”.

Explanatory Note

This Note is not part of the Regulations)

These Regulations amend Schedule 4 to the Weights and Measures (Packaged Goods) Regulations following implementation of Council Directive 90/384/EEC on the harmonisation of the laws of member States relating to non-automatic weighing instruments in the Non-automatic Weighing Instruments (EEC Requirements) Regulations 1992. These Regulations amend the categories of equipment prescribed for use in making up and checking regulated packages under Part V of the Weights and Measures Act 1985 so as to include instruments complying with those Regulations.
