The Secretary of State for Social Security, in exercise of the powers conferred by sections 138(2) and (4) and 175(1), (3) and (4) of the Social Security Contributions and Benefits Act 1992(1) and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee(2) that proposals in respect of these Regulations should not be referred to it, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Social Fund Cold Weather Payments (General) Amendment (No. 2) Regulations 1992 and shall come into force—

(a)for the purposes of regulation 6, on 31st October 1992;

(b)for all other purposes, on 1st November 1992.

(2) In these Regulations “the principal Regulations” means the Social Fund Cold Weather Payments (General) Regulations 1988(3).

Amendment of regulation 1 of the principal Regulations

2.  In paragraph (2) of regulation 1 of the principal Regulations (citation, commencement and interpretation)—

(a)at the beginning there shall be inserted the words “Schedule 2 to these Regulations (meaning of references to Post Office postcode areas and sectors) shall have effect and”;

(b)the definition of “Post Office postcode area” shall be omitted and in its place there shall be inserted—

  • “postcode”, except in the definition below of “sector”, includes a part of a postcode;

Amendment of regulation 2 of the principal Regulations

3.—(1) In paragraph (1)(b) of regulation 2 of the principal Regulations (prescribed circumstances for cold weather payments) after the words “Post Office postcode area” there shall be inserted the words “or part of such an area”.

(2) In paragraph (2) of the said regulation 2—

(a)after the words “Post Office postcode areas”, in sub-paragraph (a), there shall be inserted the words “or parts thereof”, and

(b)after the words “Post Office postcode area”, in both places where they occur in sub-paragraph (b), there shall be inserted the words “or part of such an area”.

(3) In paragraphs (1) and (2) of the said regulation 2 for the word “described”, wherever it occurs, there shall be substituted the word “identified”.

Amendment of Schedule 1 to the principal Regulations

4.  In Schedule 1 to the principal Regulations (Post Office postcode areas assigned to designated National Climatological Message Stations)—

(a)for the heading of column (2) of Schedule 1 to the principal Regulations there shall be substituted the heading

  • Identification of Post Office postcode areas or parts thereof;

(b)for entries 8, 11, 22, 23, 25, 33, 34, 53, 56, 58, and 61, there shall be respectively substituted the entries in Schedule 1 to these Regulations.

Amendment of Schedule 2 to the principal Regulations

5.  For Schedule 2 to the principal Regulations (definition of Post Office postcode area) there shall be substituted the Schedule set out in Schedule 2 to these Regulations.

Revocation

6.  The Social Fund Cold Weather Payments (General) Amendment Regulations 1992(4) are revoked.

SCHEDULE 2POST OFFICE POSTCODE AREAS AND SECTORS

1.  In these Regulations a reference to an identified Post Office postcode area is a reference to that part of Great Britain which is identified by the postcode in question in the Postcode Atlas of Great Britain and Northern Ireland published by John Bartholomew & Son Ltd. in 1989(5) except that, in the case of a Post Office postcode area identified by a postcode specified in column (1) of Table 1 below, such a reference is a reference to that part of Great Britain which is so identified in the postcode map published by Datamaps Ltd.(6) which is described opposite thereto in columns (2), (3) and (4) of the said Table.

2.  In these Regulations a reference to an identified sector of a Post Office postcode area identified by a postcode specified in column (1) of Table 2 below is a reference to that part of that area which is identified by the sector’s postcode in the postcode map published by John Bartholomew & Son Ltd. which is described in columns (2) to (5) of the said Table opposite that area’s postcode.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend Schedule 1 and substitute a new Schedule 2 to the Special Fund Cold Weather Payments (General) Regulations 1988 changing the areas linked to national climatological message stations by way of Post Office postcodes.

The Postcode Atlas of Great Britain and Northern Ireland and the postcode maps may be obtained from their publishers.

A person may establish the current postcode for his address by contacting any post office.

The Social Fund Cold Weather Payments (General) Amendment Regulations 1992 (which have not come into force) are revoked.
