The Transport and Works (Guided Transport Modes) Order 1992

The Secretary of State, in exercise of the powers conferred by section 2(1) and (2) of the Transport and Works Act 1992(1) (hereinafter referred to as “the Act”) and of all other enabling powers, hereby makes the following Order, a draft of which has been approved by resolution of each House of Parliament:—

Citation and commencement

1.  This Order may be cited as the Transport and Works (Guided Transport Modes) Order 1992 and shall come into force on 1st January 1993.

Prescribed modes

2.  The Secretary of State hereby prescribes the following modes for the purposes of section 1(1)(d) of the Act:

(a)aerial cableway;

(b)lift;

(c)magnetic levitation;

(d)monorail;

(e)road-based with cable guidance;

(f)road-based with rail guidance;

(g)road-based with side guidance;

(h)track-based with side guidance.

Interpretation

3.—(1) In this Order—

“aerial cableway” means a mode in which the vehicles are supported and guided by means of a cable, but does not include a funicular railway or a lift;

“lift” means a mode in which the vehicle—

(a)

is moved wholly or partly between guides which are vertical or inclined at an angle of less than 15 degrees to the vertical; and

(b)

provides direct access at more than one level to a street;

“magnetic levitation” means a mode in which the vehicles are supported and guided wholly or mainly by means of magnetic force;

“monorail” means a mode in which the vehicles are supported and guided wholly or mainly by means of a single rail or beam;

“road-based with cable guidance” means a mode in which the vehicles—

(a)

are capable of operating on a road; and

(b)

are guided wholly or mainly by means of a cable, wire or other device which is not in direct physical contact with the vehicles;

“road-based with rail guidance” means a mode in which the vehicles—

(a)

are capable of operating on a road; and

(b)

are guided wholly or mainly by means of a single rail or slot;

“road-based with side guidance” means a mode in which the vehicles—

(a)

are capable of operating on a road; and

(b)

are guided wholly or mainly by means of wheels bearing outwards against fixed apparatus; and

“track-based with side guidance” means a mode in which the vehicles—

(a)

are supported by means of a track or other structure not being a road; and

(b)

are guided wholly or mainly by means of wheels bearing outwards against fixed apparatus.

(2) In this Order, references to “mode” are to be construed as a mode of guided transport which employs vehicles used wholly or mainly for the carriage of passengers and “road” has the same meaning as in the Road Traffic Regulation Act 1984(2).

Explanatory Note

(This note is not part of the Order)

This Order applies the provisions of Part I of the Transport and Works Act 1992 (which provides for the making of orders authorising the construction and operation of certain systems of transport and related matters) to the modes of guided transport prescribed in Article 2 and defined by Article 3 of this Order. The application of the Order is limited to modes whose sole or primary purpose is the carriage of passengers.

The modes so prescribed are those which take the form of an aerial cableway or a monorail; or which employ magnetic force for support and guidance; or which are capable of operating on roads but which derive guidance from a buried cable (electronically, magnetically or by other means), a single rail or slot, or side-mounted apparatus; or which operate on a segregated track and derive guidance from sidemounted apparatus. Also prescribed are lifts, but only those serving street areas and which are not inclined at an angle of 15° or more from the vertical. Lifts beyond this degree of inclination are funicular railways for the purposes of the Act.
